My employer expects me to work through breaks when it's busy. Can they do this?

Your employer must give you at least the rest breaks required by the Working Time Regulations, but must also make sure that your health and safety is not put at risk, so your breaks could amount to more than the minimum.

The amount of break time is usually agreed with your employer and might be written down as part of your employment contract with them.

If you're an adult worker (over 18), you'll normally have the right to a 20 minute rest break if you're expected to work for more than six hours at a stretch.

A lunch or coffee break can count as your rest break.

Additional breaks might be given by your contract of employment. If you use computers, your employer should plan your work so that you can take regular breaks from looking at the screen

It is recommended that you take your rest breaks, as they are there to protect your health and safety and it is your entitlement. 

If you're worried you're not getting the right number of breaks or the right amount of time off on breaks, speak to your manager. If you're unable to resolve the problem contact your local union rep.
