The CWU has initiated legal action on behalf of about 600 former Rivus Fleet Solutions employees affected by a complex TUPE (Transfer of Undertakings Protection of Employment) situation. These employees lost their jobs and were not paid full contractual redundancy payments due to a dispute involving Rivus, BT, and Holman Fleet Services. Holman denied TUPE applicability, leading to a chaotic situation when Rivus’s service contract for BT and Openreach vehicles ended, resulting in 48 of 54 garages closing. The union’s legal claim focuses on failures in informing and consulting employees about the TUPE and redundancy situation. The union also plans to reopen membership for affected former Rivus employees.
